Terms of Service

1. Acceptance of Terms

By accessing the VinDevs website (https://www.vindevs.xyz), joining a VinDevs-operated Discord server, running our bot, or linking a Roblox account, you agree to these Terms and to all platform rules imposed by Discord and Roblox. If you do not agree, do not use the services.

2. Eligibility

You must be at least 13 years old (or the minimum age required by your jurisdiction and by Roblox/Discord) to use VinDevs services. You are responsible for ensuring that your use complies with the laws of your country and the agreements of platforms you connect.

3. Accounts & Verification

Discord and Roblox accounts must be accurate and under your control. You may only link accounts you own, and you must maintain the security of your credentials. Account sharing and impersonation are prohibited. Removal of access due to security concerns can occur without notice.

4. Marketplace & Portfolios

• Content must be original or properly licensed. Submitting plagiarized assets, violating Roblox's IP rules, or misrepresenting your identity is grounds for removal.
• Posts must include accurate pricing, availability, and contact details. Abandoned or misleading listings may be declined.
• VinDevs staff may edit, suspend, or cross-post listings to partner guilds to maintain consistency.
• Portfolios and marketplace submissions are reviewed before publication. Reviews may require additional evidence, proof of ownership, or revisions.
• Marketplace submissions may be queued for staff review whether they originate from the website or Discord bot.
• Repeated policy violations may result in temporary marketplace or portfolio submission mutes.
• Admissions and skill applications may require code samples, media proofs, or demo videos to validate experience claims.

5. Middleman & Payments

• By engaging the VinDevs Middleman Desk you authorize us to collect instructions, files, and payment confirmations required to complete the transaction.
• VinDevs is not responsible for tax obligations or disputes between client and developer. Our role is limited to the functions explicitly described in the middleman ticket.
• Refunds or chargebacks performed outside sanctioned payment methods are considered violations and may result in removal from the network.

6. Prohibited Conduct

• Misrepresenting identity, ratings, or linked accounts.
• Posting scams, malware, or directing users to platforms that violate Roblox/Discord terms.
• Evading moderation decisions or recreating accounts to bypass restrictions.
• Data scraping, automated usage that harms service stability, or attempting to reverse engineer proprietary functionality.

7. Moderation & Enforcement

VinDevs reserves the right to remove content, suspend commands, restrict guild access, or terminate accounts at our sole discretion in order to protect users and comply with partner policies. Moderation decisions may be shared with Roblox’s Developer Engagement Team or Discord Trust & Safety when required.

8. Ownership & License

You retain ownership of the content you submit, but grant VinDevs a worldwide, royalty-free license to host, display, and distribute that content across VinDevs-managed channels for the purpose of operating the marketplace, portfolios, and marketing communications. You confirm that you have the rights necessary to grant this license.

9. Service Availability

The VinDevs platform is provided “as is.” We do not guarantee uninterrupted uptime, error-free operation, or future availability of any feature. Maintenance windows, API rate limits, and platform outages may affect service.

10. Disclaimers

To the fullest extent permitted by law, VinDevs disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We provide tools to help creators and clients connect, but we cannot guarantee the performance of any user nor the outcome of any engagement.

11. Limitation of Liability

VinDevs, its partners, and staff will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your access to or use of the services. Our aggregate liability for all claims shall not exceed fifty (50) U.S. dollars.

12. Indemnification

You agree to indemnify and hold harmless VinDevs, its partners, staff, and affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your content, your use of the services, or your breach of these Terms.

13. Termination

You may stop using the services at any time. VinDevs may suspend or terminate your access immediately if we believe you have violated these Terms, engaged in fraud, or posed a risk to the community. We may retain records after termination to comply with legal or moderation obligations.

14. Changes to Terms

We may update these Terms as Roblox, Discord, or VinDevs requirements evolve. We will notify users of material changes via the dashboard and Discord announcements. Continued use after an update means you accept the revised Terms.

15. Governing Law

These Terms are governed by the laws applicable in the jurisdiction where VinDevs is registered, without regard to conflict of law principles. Any disputes will be resolved in the courts of that jurisdiction.
